What is a DWI?

In the state of Texas, a DWI is when someone is found guilty of driving a vehicle with a blood alcohol content of 0.08 or higher. This can be a serous charge which you may wish to dispute with the aid of a professional DWI attorney.

How do police detect a drunk driver?
Police can pull you over and test you if they sense that you have been drinking. Some common reasons an officer may suspect that someone is under the influence of alcohol can include:
  • Drifting
  • Swerving
  • Not staying in your lane
  • Driving 10 miles or more below the speed limit
  • Driving on the wrong side of the road
  • Braking abruptly
  • Weaving in and out of lanes
  • Using turn signals incorrectly (for example: signaling to go right but then going left)
Can you be charged with a DWI even if your BAC is below 0.08?
Yes. If you are pulled over or hit another vehicle/person in an accident and your BAC is found to be under 0.08, you can still be charged. A police may consider you “noticeably impaired” in this instance.
What should you do after you are charged with a DWI?

Being convicted of a DWI will remain on your record forever and can have a negative impact on your future opportunities. What is BAC?
BAC stands for Blood Alcohol Content, the amount of alcohol in a person's body measured by the weight of the alcohol in a certain amount of blood.
Do I need to take a field sobriety test?

Texas law does not require you to take a field sobriety test. It is your decision. Our knowledgeable DWI attorneys can provide you with more information about these regulations.

Do you have to perform a breath test?
You are not required to perform a breath test. Roadside tests are not allowed as evidence in Texas courts as they are often unreliable. If you take one at the police station, these are more reliable and can be used against you.
Will my license automatically be suspended if I am arrested for drunk driving?
No, it is not automatically suspended. However, Texas requires all drivers to submit to a breath or blood test if suspected of a DWI. Failure to do so can result in an administrative license suspension.
Do I need to work with a DWI attorney?

While it is not required to obtain a DWI attorney, it will help your case as you will be working with an attorney that has the knowledge and experience needed to fight for you. For a trusted drunk driving attorney in the Midland and San Angelo, TX area, contact the office of Gray and Brigman PLLC.
